WHAT EMPLOYERS NEED TO KNOW:

👉🏻Casual employees can bring dismissal claims if they've worked regularly and systematically and had a reasonable expectation of ongoing work.

👉🏻Simply removing a casual from the roster without explanation may be seen as a dismissal.

👉🏻Always check if the employee meets the Fair Work definition of a casual and follow a fair process to avoid legal risks.

👉🏻Keep records of conversations, warnings, and changes in shifts or hours. Written documentation can protect your business in the event of a claim.

👉🏻Treat casual terminations with the same care you would for permanent staff - respect, fairness and compliance are key.
